Exceptions: Disputes about the existence, scope, or validity of this arbitration provision are not subject to arbitration.

9.1 Small Claims Court Exception

You or Spectra Coffee may bring an individual claim in small claims court if the claim falls within that court’s jurisdiction.

9.2 Good-Faith Resolution Attempt

Before filing an arbitration claim:

You must first give Spectra Coffee an opportunity to resolve the issue by submitting a written description of your claim to our Customer Service team.

We agree to negotiate in good faith for 60 days.

If the dispute is not resolved within 60 days, you may proceed to arbitration (or small claims court, if applicable).

9.3 Arbitration Procedure

Arbitration may be initiated by either party by sending a written request to Spectra Coffee’s Customer Service.

If we cannot mutually agree on an arbitrator within 30 days, the dispute will be arbitrated by JAMS Arbitration Services.

JAMS arbitration rules apply unless both parties agree otherwise.

9.4 Arbitration Costs

Spectra Coffee will cover all filing, administration, and arbitrator fees.

For claims under $75,000, if you are the prevailing party, you will be entitled to recover reasonable attorneys’ fees and costs.

10. WAIVER OF CLASS ACTION

To the fullest extent permitted by U.S. law, you and Spectra Coffee agree that any legal proceedings—whether in arbitration or court—will be conducted solely on an individual basis and not as part of a class action or representative lawsuit.

No Class Actions: You waive the right to participate in any class, collective, consolidated, or representative legal action.

Individual Claims Only: You may seek relief only on your own behalf and only to remedy your individual claims.

6. SHIPMENT AND DELIVERY

8. RETURN AND REFUNDS

Non-returnable products: Food products and any items identified as non-returnable at the time of purchase cannot be returned.

Return eligibility: If your item is substantially intact, you may return it within 30 calendar days of the delivery date for a refund, excluding original shipping and handling costs.

Return process:

✔ Contact Spectra Coffee Customer Service with a written request for return, including your Order information and details of the product.

✔ Once we confirm eligibility, we will provide a return address.

You must return the product within 14 days of receiving the return instructions.

Important Notice:

•You bear the risk of loss during return shipping.

9. LIMITED WARRANTY

Spectra Coffee warrants that products purchased on the Site will be free from defects for a period of 30 days from the date of the Order (“Warranty Period”).

If a defect is identified within the Warranty Period, Spectra Coffee will, at its sole discretion:

Issue a refund of the purchase price.

Warranty Limitations

How to Claim a Warranty:

3.Spectra Coffee will pay for shipping of the repaired/replacement product if the warranty claim is valid.

LIMITATION OF LIABILITY:

Spectra Coffee’s liability is strictly limited to the purchase price of the defective product. Under no circumstances will Spectra Coffee be liable for:

✔ Loss of work, data, use, business, revenue, or profit.

Consequential, incidental, special, or punitive damages.
